Description: The San José City Council voted on September 1, 2020 to begin charging commercial developers fees to fund affordable housing. All non-residential projects and non-residential portions of a project will pay the fee based on the gross square footage of each use included in the proposed project by geographic subarea. Description: The Inclusionary Housing Ordinance, Chapter 5.08 of the San José Municipal Code, was adopted on January 12, 2010. The IHO requires all residential developers who create new, additional, or modified For-Sale or Rental units to provide 15% of housing on-site that is affordable to income qualified buyers/renters specified below. The base obligation is where 15% of the Inclusionary Units are provided On-Site. The Ordinance applies to developments with 10 units or more as of May 1, 2021.
